For a marker less than $650, the charge is a misdemeanor that carries a possible jail term of six (6) months and a $10,000 fine. Unpaid markers of $650 or more are class D felonies, with penalties including a jail term of one (1) to four (4) years in state prison, a fine of $5,000, full restitution, payment of all fees and costs, and burdensome probation periods.
